 What's tort reform? Does anyone out there apart from attorneys and politicians really know very well what tort reform is? I think most people out there have been completely misled about what tort reform really is, not to mention how it'd affect them. We have been misled by those who it'll affect in an adverse way, like corporations and insurance companies.


I'm a forty (I mean, twenty nine) year-old woman who works for an attorney, and whose father was an attorney, and I am ashamed to state that I did not understand what tort reform meant until a couple of months ago. What happened a couple of months ago? Well, the attorney I benefit mails out law bulletins for his clients several times annually and the topic this time around was, you guessed it, tort reform. This inspired me to take a deeper research the topic.

I realized when I started researching that his bulletin was barely the tip of the iceberg. He could not have already been able to add everything on the topic in a one page bulletin. Tort reform research is just a daunting task; i'd like to let you know, we shall never reach the finish of the debate. This really is because there are a lot of high profile players in this game and an excessive amount of money involved.

I think if you are injured or you incur damages due to someone else's fault, then you should be entitled to be reimbursed by that person, don't you? Isn't that what we teach our kids?

I understand some people attempt to take advantage of the system--that will happen regardless of what sort of restrictions we attempt to impose. (Animals have been known to consume their own kind when starving, after all.) Therefore, we must punish the majority for the sins of the few? That is ridiculous. Isn't that why we have a legal system, for impartial judgement and rulings of our situations as governed by our laws?

I also recognize that a lot of cases like these could cost a lot of money, however for whom? Well, this is a complaint that hails from the insurance companies who do not need to fund claims they have promised to cover, and from large corporations who do not wish to be held accountable for their negligence.

The truth is that a huge selection of tens and thousands of folks are injured every year due to the actions of others. The fact is that those responsible should really be held accountable. You don't see your neighbor or your brother wanting to push tort reform so they don't have to fund the medical bills they caused someone as a result of hitting them making use of their car. And, even if you did, everyone around would cry out at the injustice. Why do we allow the insurance companies and corporations to continue their injustice? The greed of the insurance companies, the greed that drives them to deny covering the expense we have paid them to cover, costs they've promised to cover; the greed of large corporations that do not want to cover out when they've been negligent. Think of all the Enron employees who lost their entire life savings because of fraud. Can anyone consider anything other than greed that fueled this disaster?
